The PEI Lobster Roll Call Contest 

CONTEST RULES (the “Rules”)

NO PURCHASE NECESSARY

 

  1. Contest Period:

The Lobster Roll Call Contest (the “Contest”) begins at 12:00:01 am Eastern Time (“ET”) on August 11th, 2021 and concludes at 11:59:59 pm ET on September 27th, 2021 (the “Contest Period”). 

  1. Eligibility:

This Contest is open to all residents of Ontario who are of the age of majority. Employees, representatives or agents of LOBSTER FISHERS OF PRINCE EDWARD ISLAND MARKETING BOARD (the “Sponsor”), its parent, affiliated or related companies, subsidiaries, divisions and all advertising, media buying and promotional agencies, NOURISH FOOD MARKETING, PRINCE EDWARD ISLAND TOURISM, Toronto Life and Contest judges, are ineligible, as well as members of the immediate family of, or persons domiciled with, any of those described above. Immediate family means parents, sisters, brothers, children or spouse.

  1. How to Enter:

To enter:  (1) click here (2) Follow the on-screen instructions to (i) allow the Contest application (the “Application”); and (ii) fully complete and submit the official Contest entry form, including by providing your First Name, Last Name and your E-mail address (the “Registration” or “Entry”).  By submitting a Registration, each entrant will receive one (1) Entry into the Grand Prize draw (Limit one (1) Registration per person).

Automatic Disqualification 

Participants are not permitted to share the same email. Any attempt by any participant to register more than once or to enter more than the number of stated Entries by using multiple/different emails, identities, registrations and logins, or any other method will void that participant’s Registration/Entries and that participant may be disqualified. Use of any automated system is prohibited and will result in automatic disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Registrations/Entries. Such Registrations/Entries will be disqualified. In the event of a dispute as to any Registration/Entry, the authorized account holder of the email address used to register will be deemed to be the registrant or entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Proof of Entry will not be deemed to be proof of receipt.


  1. Grand Prize: 

There will be One Grand Prize available consisting of: a three (3) night accommodation (double occupancy) on Prince Edward Island with two (2) individual round-trip economy flights to Prince Edward Island (ARV $3,000). All flights and accommodations must be taken all together prior to August 31, 2022. Grand Prize also includes one (1) $200 Canada’s Food Island gift card.

  1. Awarding of Prize:

A random draw will be made by Toronto Life to identify one (1) potential winner for the Grand Prize, selected from among all eligible Entries received during the Contest Period who otherwise complies with these Rules. If the individual selected does not meet the Rules, then subsequent draw(s) may be held in order to select another entrant who is eligible and otherwise complies with these Rules, in order to distribute the Grand Prize. The odds of winning a Grand Prize depend on the number of eligible entries received during the Contest Period.

A POTENTIAL PRIZE WINNER IS SUBJECT TO VERIFICATION BY SPONSOR AND ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. A potential winner will be contacted using the email address provided with the Entry and must respond within​ 48 hours. Failure to respond to this email within 48 hours of notification or return of e-mail notification as undeliverable will result in disqualification.

Terms and Conditions 

To claim his/her prize, each potential winner must fulfill the following: 1) Each prize winner must complete the official contest entry form. 2) Each Prize winner must complete and answer a mathematical skill testing question. 3) Each prize winner must sign a declaration of compliance. 4) Each prize winner must agree with and sign a publicity release. 5) Each prize winner shall go through a verification process. Once the rules, terms and conditions have been verified the winner will be declared and announced.

If a potential winner does not comply with these Rules or cannot be contacted or fails to respond with the specified time or fails to correctly answer the skill-testing question or fails to provide the required information or documentation or if the prize, prize notification or verification is returned as undeliverable, the potential winner will be disqualified and he/she forfeits the prize. A potential winner is not a winner of any prize, even if the website should so indicate, unless and until the potential winner has been confirmed a winner in accordance with these Rules. Sponsor will not accept screenshots or other evidence of winning in lieu of its validation process.

Prize must be accepted as awarded. Prize may not be refunded or transferred and is not convertible to cash. Sponsor reserves the right, in their sole discretion, to substitute all or a portion of a prize with a prize of equal or greater value for any reason. Unclaimed prizes will not be reissued. By accepting a prize, winner authorizes the Sponsor to broadcast, publish and disseminate their name, city and province of residence, photographs, likenesses, comments and voices, in connection with any promotion or publicity at no further compensation to the winner. In the event a potential winner is disqualified or not eligible, he/she shall not be awarded the prize and that prize may not be awarded, and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

  1. Entry Conditions and Release:

By entering, each entrant agrees to: (a) comply with and be bound by these Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor, and their respective parents, subsidiaries, affiliated and related companies, the prize suppliers, Toronto Life, the Contest judges and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, shareholders, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, arising from or in connection with the Contest or an entrant’s acceptance, use or misuse of a prize; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable legal fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use or misuse of prize.

  1. Limitations of Liability:

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the registration or entry process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of Entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Entry in the Contest. No more than the stated number of prizes will be awarded.

  1. Disputes:

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the Prince Edward Island Courts; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event legal fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the entrant and Sponsor and Administrator in connection with the Contest, shall (unless otherwise prohibited by law) be governed by, and construed in accordance with, the laws of the Province of Prince Edward Island, without giving effect to any choice of law or conflict of law rules (whether of the Province of Prince Edward Island or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Prince Edward Island.

  1. General Rules:

    a) All information provided by the entrant shall become the property of the sponsor and will not be returned.
    b) Sponsor reserves the right in its sole and absolute discretion to cancel, withdraw, amend, terminate or suspend this Contest in whole or in part at any time without prior notice or obligation for any reason,  including but not limited to if a virus, bug or other cause beyond the reasonable control of Sponsor corrupts the security, fairness or proper administration of the Contest. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the registration or entry process or the operation of the Contest or to be acting in violation of these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest, including fraudulently claiming any prize, is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.c) This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. All decisions of the Sponsor are final, binding and conclusive in all matters relating to this Contest.d) All Entries are subject to verification (including requirement to submit proof of identification) and Sponsor reserves the right to cancel and revoke any Entries if they are found to be improper or if the entrant is subsequently found not to be eligible pursuant to these Rules. Proof of submitting an Entry is not proof of receipt by Sponsor.e) Winners must accept prize delivery upon Sponsor’s terms and delivery times. Any shipped prizes are not insured and Sponsor shall not assume any liability for lost, stolen, late, destroyed, damaged, or misdirected prizes.f) By registering for the Contest, all entrants consent to the collection, use and disclosure of their personal information by Sponsor for the purposes of administering and promoting the Contest, and otherwise in accordance with the Sponsor’s Privacy Policy, available at https://lobsterpei.ca/privacy-policy/ or as permitted or required by law. If you consent, personal information may also be used to send you information and special offers regarding the Sponsor’s products.
